SUMMARY OF ORDINANCE NO. 1323 

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SIERRA MADRE ADDING 
CHAPTER 17.61 TO THE MUNICIPAL CODE TO BE ENTITLED “REASONABLE 
ACCOMMODATIONS” 

In accordance with the Federal Fair Housing Act and the California Fair Employment and Housing Act (“the Acts”), it is 
the policy of the City to provide people with disabilities reasonable accommodations as necessary to ensure equal access to 
their dwelling unit and/or place of business. The purpose of Ordinance No. 1323 is to provide a clear and defined process 
for people with disabilities to make reasonable accommodation requests from existing standards in the city’s development 
code. Any person with a disability, or his or her representative, may request a reasonable accommodation from a land use 
or zoning regulation, policy, practice or procedure when necessary to afford such persons equal opportunity to use and enjoy 
their dwelling unit or place of business. A person with a disability is a person who has a physical or mental impairment that 
limits or substantially limits one or more major life activities, anyone who is regarded as having such impairment or anyone 
who has a record of such impairment. This Ordinance is intended to apply to those persons who are defined as disabled under 
either of the Acts.

The Ordinance provides the contents required to be submitted with an application for a reasonable accommodation. No 
application fee will be required for a request for reasonable accommodation, but if the project requires another discretionary 
permit and environmental review, then the prescribed fee shall be paid for that discretionary permit and environmental review. 
The Ordinance provides the criteria for granting accommodations. Review of requests for reasonable accommodation shall 
be reviewed by the Director of Development Services. A determination by the Director to grant or deny a request for 
reasonable accommodation is appealable to the Planning Commission. 

On October 11, 2011, the City Council approved Ordinance No. 1323 for first reading. Pursuant to Sections 15301, 15305, 
15311, and 15061(b)(3) of the California Environmental Quality Act Guidelines, Ordinance No. 1323 was determined to be 
exempt from environmental review. The City Council will consider a second reading of Ordinance No. 1323 on October 25, 
2011.

SB 161 SIGNED INTO LAW DESPITE UNION OPPOSITION 
HEALTH & SAFETY NEEDS OF CALIFORNIA 
SCHOOLCHILDREN PUT FIRST

SACRAMENTO: Groundbreaking 
student safety legislation 
authored by Senator 
Bob Huff (R-Diamond 
Bar) has been signed by the 
Governor. The Governor’s 
signature on SB 161 means 
that California school employees, 
who volunteer and 
are properly trained, will be 
authorized by law to provide 
emergency medical assistance 
to pupils with epilepsy 
who suffer a seizure while on 
campus.

SB 161 was sponsored by 
the Orange County Office of 
Education and the Epilepsy 
Foundation of California. It 
faced heavy opposition from 
powerful union special interests 
during nearly every legislative 
committee hearing. 
The Huff legislation will help 
protect the lives and health 
of nearly 94,000 California 
children who suffer from 
epilepsy.

“The Governor’s signature 
on SB 161 marks the victorious 
end to a long and bitter 
fight to provide the safety 
net that children with epilepsy 
desperately need in our 
schools,” said Senator Huff. 
“This victory proves that a 
determined group of parents, 
doctors, schools and other 
citizens can overcome even 
the most powerful of special 
interests.”

Children who suffer from 
epilepsy are at risk of dangerous 
and prolonged seizures 
and must have immediate 
access to life-saving emergency 
medication. Diastat 
Acudial is a pre-dosed 
preparation of diazepam 
gel and is the only standard, 
out-of-hospital treatment 
that has been approved by 
the Food and Drug Administration 
(FDA) to successfully 
treat prolonged 
seizures. It is also the only 
FDA approved medication 
that was specifically developed 
to be administered 
by people without medical 
training and is considered 
the fastest, safest and most 
effective way to treat epileptic 
seizures.

“If the medication is not administered 
within a matter 
of minutes following a seizure, 
children can begin to 
suffer severe brain damage 
and even death,” said Senator 
Huff.

Senator Huff responded 
with legislation on behalf of 
thousands of children with 
epilepsy when the Board of 
Registered Nursing (BRN) 
arbitrarily ruled two years 
ago that nurses were not authorized 
to train or supervise 
anyone to administer Diastat. 
Schools abruptly stopped the 
practice following the ruling, 
even though the drug had 
been successfully used in 
California schools for more 
than ten years with absolutely 
no problems and no incidents 
of medical problems.

Leading California pediatricians 
testified in support of 
SB 161 during the committee 
hearing process and 35 
physicians submitted a letter 
to the Governor urging him 
to sign the legislation. That 
includes Dr. Raman Sankar, 
who serves as the Professor 
of Neurology and Pediatrics 
and Chief of Pediatric Neurology 
at the David Geffen 
School of Medicine at UCLA.

“The safety of this medication 
has been acknowledged 
by everyone involved with 
pediatric neurology and pediatric 
epilepsy, which is 
why SB 161 has strong support 
from professional medical 
organizations,” said Dr. 
Sankar during committee 
testimony.
