ORDINANCE NO. 1339

AN ORDINANCE OF THE CITY OF SIERRA MADRE, CALIFORNIA AMENDING CHAPTER 9.36
OF THE SIERRA MADRE MUNICIPAL CODE PERTAINING TO ALARMS

WHEREAS, on May 14, 2013, the City Council conducted a public hearing to review the City’s fees for Fiscal Year 2013-2014;

WHEREAS, the City Council discussed alarm fees and penalties;

WHEREAS, the City Council did not implement alarm fees, but did request that the penalties for false alarms be modified, which requires a
change in the Municipal code;

THE CITY COUNCIL OF THE CITY OF SIERRA MADRE DOES HEREBY ORDAIN AS FOLLOWS:

SECTION 1. Chapter 9.36.030 – Public nuisance alarms use and operation prohibited is hereby amended to read:

9.36.030– Public nuisance alarms use and operation prohibited. No alarm owner shall use or operate any alarm system
classified as a public nuisance hereunder. For the purpose of this chapter, “public nuisance alarms” are those which generate more than one
false alarm in any twelve-month period. These constitute a public nuisance due to the inordinate response time and risk attributable thereto.

SECTION 2. Chapter 9.36.070 – Corrective action is hereby amended to read:

9.36.070 Corrective action. On the first false alarm, a “False Alarm Notification Card” will be left at the location,
describing the violation and specifying that a second and subsequent violations, within a 12 month period, will result in the imposition of a
fine. The fines shall be established by resolution of the City Council

SECTION 3. If any sections, subsections, subdivisions, paragraph, sentence, clause or phrase of Ordinance 1339 is for any reason held to be
invalid, such invalidity shall not effect the validity of the remaining portions of this Ordinance or any part thereof or exhibit thereto.

The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase hereof,
irrespective of the fact that anyone or more sections, subsections, subdivisions, paragraph, sentences, clauses or phrases be declared invalid.
SECTION 4. The City Clerk shall cause this Ordinance to be published or posted in accordance with California Government Code Section
36933, shall certify to the adoption of this Ordinance and his/her certification, together with proof of the publication, to be entered in the book
of Ordinances of the City Council.

PASSED, APPROVED and ADOPTED this 25th day of June, 2013.

ORDINANCE NO. 1337

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SIERRA MADRE ADDING CHAPTER 17.29 ENTITLED “R-3 H
MULTIPLE FAMILY RESIDENTIAL HIGH DENSITY” TO THE
MUNICIPAL CODE AND AMENDING THE ZONING MAP.

WHEREAS, State law recognizes the vital role local governments play in the availability,
adequacy and affordability of housing, and every jurisdiction in California is required to adopt
a long-range General Plan to guide its physical development;

WHEREAS, the Housing Element is one of seven mandated elements of the General Plan;

WHEREAS, the State’s Housing Element law mandates that local governments adequately
plan to meet their “fair share” of the existing and projected housing needs of all economic
segments of the community identified in their Regional Housing Needs Assessment (RHNA);

WHEREAS, the State’s Housing Element law recognizes that in order for the private market to
adequately address housing needs and demand, local governments must adopt land use plans
and regulatory systems that provide opportunities for, and do not unduly constrain housing
production;

WHEREAS, the 2008-2014 Housing Element, which was prepared to address the requirements
of the State’s Housing Element law, was reviewed and approved by the State Department of
Housing and Community Development on February 13, 2013;

WHEREAS, the State’s Housing Element law requires that appropriate zoning be provided to
meet a jurisdiction’s “fair share” of the existing and projected housing needs of all economic
segments of the community identified in their RHNA allocation;

WHEREAS, an Objective of the approved 2008-2014 Housing Element states that the City will
prepare new R-3H zoning development standards to address the State’s statutory requirement
that zoning that allows a minimum density of 20 dwelling units/acre be available to facilitate
the production of affordable housing;

WHEREAS, implementation of the 2008-2014 Housing Element requires the adoption of a
new R-3H Zoning Ordinance to provide development standards that address the 20 dwelling
units/acre minimum density required by State Housing law. The zoning ordinance establishes
development standards applicable to properties zoned R-3H, and must be adopted by ordinance
to have regulatory effect;

WHEREAS, the proposed changes are consistent with the General Plan in that it would
establish the appropriate zoning standards to ensure orderly and compatible development of
higher density multi-family properties with surrounding properties; and

WHEREAS, an environmental initial study was performed pursuant to the California
Environmental Quality Act (“CEQA”) and the City staff has recommended that a Negative
Declaration be adopted indicating that the amendments will not have a significant adverse
effect on the environment;

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Sierra Madre
as follows:

SECTION 1: Chapter 17.29 of the Sierra Madre Municipal Code is hereby added to be
entitled “R-3H Multiple Family Residential High Density.” The Chapter shall read as follows:

17.29.010 Purpose - The purpose of this chapter is to provide zoning development
standards to accommodate the City’s regional housing needs for all income levels. The
regulations set forth in this chapter shall be applicable to all properties classified in an R-3H
zone.

17.29.020 Permitted Uses - In the R-3H zone, only such uses are permitted as are
hereinafter specifically provided and allowed:

A. Multiple Family dwellings.
B. Accessory buildings and uses customarily incidental to apartment house
or condominium development. Architectural styling of such accessory buildings

shall be the same as that of the main structure or structures.

C. A public parking area.
D. Any use permitted in the R-1 zone.
E. Any use permitted in the R-2 zone.
17.29.030 Development Regulations

A. R-1 development is subject to the requirements of the R-1 zone (Chapter
17.20.)

B. R-2 development is subject to the requirements of the R-2 zone (Chapter
17.24).

C. The regulations and limitations pertaining to the R-3 zone shall control and be
effective development standards in the R-3H zone (Chapter 17.28 of this title) for multi-family
dwellings, with the following exceptions: Allowable Density: Up to 20 dwelling units/acre;

1. Multi-family projects are not subject to the requirements of Section 17.60.030.

SECTION 2. Zoning Map Amendment. The Zoning Map is hereby revised consistent with
Exhibit B.

SECTION 3: Severability: If any selection, subsection, subdivision, sentence, clause or
phrase of this Ordinance is for any reason held to be unconstitutional or otherwise invalid,
such decision shall not affect the validity of the remaining portions of this Ordinance. The City
Council hereby declares that it would have passed this Ordinance and each section, subsection,
subdivision, sentence, clause and phrase hereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses or phrases be declared unconstitutional.

SECTION 4: The City Clerk shall certify to the adoption of this
ordinance and shall cause the same to be published or posted in the manner prescribed by law.

SECTION 5: Based on the information in the Negative Declaration
and its independent review, the City Council declares that the project will not have an adverse
impact on the environment and adopts the Negative Declaration and directs that a Notice of
Determination be filed.

PASSED AND ADOPTED this 11th day of June, 2013.

SIERRA MADRE

Like many people, after a long day
at work, I look forward to coming
home and relaxing with a nice
dinner or my favorite television
show. As a Sierra Madre resident,
I enjoy the cool mountain air and
I like to open my windows when I
get home while I get dinner ready
and start to unwind from the day’s
events. Unfortunately, most days
as soon as I settle at the table or
couch, food in hand and get ready
to turn on my favorite show, a
smell wafts into my apartment unit
from the outside. As I pause, fork
in hand, the smell becomes more
prominent and it can be easily
identified as tobacco smoke.

As an apartment resident, any
smoking inside the units, on the
balconies, etc. wafts into the unit
and overpowers the fresh air I
was previously enjoying. Can you
imagine smelling tobacco smoke
and being exposed to the harmful
effects in your home on a daily basis?
If you have never experienced
drifting secondhand smoke as an
apartment or condominium resident,
I can tell you that not only
is it an unpleasant experience, but
it can negatively affect your health
as well. The dangerous effects of
secondhand smoke have been researched
time and time again and
the results are irrefutable: “secondhand
smoke is harmful to your
health!”

As a member of the Clean Air for
Residential Environments (CARE)
Sierra Madre coalition, which is
composed of Sierra Madre residents
and health advocates, I am
interested in safeguards to protect
residents from secondhand smoke
exposure at home. Despite public
settings where an individual can
often walk away from the smoke,
in a home environment, Sierra
Madre residents have no option
when it comes to protecting themselves
from drifting secondhand
smoke except to move, which is
not an easy option for many people.
As a Sierra Madre resident and
member of the CARE coalition, we
have worked now for over 3 years
for a smoke-free multi-unit housing
ordinance in the City of Sierra
Madre which will help protect the
health of all residents.

This ordinance is not about infringing
on people’s rights, but
rather it’s about protecting the
health of the community members
including children and older
adults. No one is denying people
the “right” to smoke, we are just
asking for an ordinance that would
ask smokers to refrain from smoking
in common areas, balconies
and inside units, where the smoke
can easily drift through the vents
being inhaled by all other neighbors.
