On March 23, 2021, the City Council of the City of Sierra Madre introduced for second reading recommending adoption 

of Ordinance 1440, amending Chapter 17.34 (Affordable Housing), Title 17 (Zoning) of the Sierra Madre Municipal Code. 
The amendment to the City’s affordable housing ordinance is to conform to recent changes to State Density Bonus Law. 


In October 2020, the Governor approved Assembly Bill No. 2345 (“AB 2345”), which revises the Density Bonus Law to 

increase the maximum density bonus, lower the thresholds to qualify for incentives and concessions, reduce the parking 
standards, provide new definitions, and impose new reporting requirements. AB 2345 took effect on January 1, 2021. 


This summary is published pursuant to Government Code Section 36933(c)(1) and a full and complete certified copy of the

ENVIRONMENTAL DETERMINATION: The adoption of this amendment is exempt from the California Environmental 
Quality Act (CEQA) under Section 15301, Title 14 of the California Code of Regulations and is also exempt from review 

because it does not meet the definition of a project under CEQAGuidelines sections 15061, subdivision (b)(3), and section 

15378, subdivision (a) and subdivision (b)(5). The proposed changes to Chapter 17.34, as authorized and required by state 
law, have no potential for resulting in physical changes to the environment because they consist of changes in the standards 
governing issuance of permits for density bonus projects and do not directly or indirectly approve any applications for 

particular projects. Any particular proposed project will be required to undergo the City’s entitlement process and appropriate 

review under CEQA. 

APPEAL: If in the future anyone wishes to challenge the decision of the City Council in court, one may be limited to raising 
the issues that were raised or presented in written correspondence delivered to the City Council at, or before, the scheduled

adoption of Ordinance 1439, repealing in its entirety Chapter 15.44 (Earthquake Hazard Reduction in Existing 
Buildings), and adding Chapter 15.44 (Earthquake Hazard Reduction in Existing Unreinforced Masonry Buildings 
and Risk Reduction Schedule), Title 15 (Building and Construction) of the Sierra Madre Municipal Code. 

The City desires as its goal the retrofitting of unreinforced masonry buildings to the standards recommended by 
the California State Seismic Safety Commission, without loss of degradation of qualified historic buildings and 

without detracting from the historic characteristics of the city. The ordinance establishes a compliance timeline and 

requirements for retrofit, demolition, penalties, and appeal procedures.

ENVIRONMENTAL DETERMINATION: 

The proposed regulations are exempt from the California Environmental Quality Act (CEQA) under Section 15301, 
Title 14 of the California Code of Regulations, which exempts the “operation, repair, maintenance, permitting, leasing, 
licensing, or minor alteration of existing public or private structures, … involving negligible or no expansion of existing 

orformeruse.” The proposed regulation is also exempt from review because it does not meet the definition of a project 

under CEQA Guidelines sections 15061, subdivision (b)(3), and section 15378, subdivision (a) and subdivision (b)(5). 
The proposed changes to Chapter 15.44, as authorized and required by state law, have no potential for resulting in 

physical changes to the environment because they consist of changes in the standards governing the seismic retrofit 
of buildings identified as posing a potential hazard and do not directly or 
indirectly approve any applications for

particular projects. Any particular proposed project will be required to undergo the City’s entitlement process and 
appropriate review under CEQA.
