REGISTRATION REQUIREMENT

On November 28, 2017 the City Council of the City of Sierra Madre introduced for second reading Ordinance No. 1390 
recommending adoption of Municipal Code Text Amendment 17-05. This summary is published pursuant to Government 

Code Section 36933(c)(1) and a full and complete certified copy of the text of Ordinance No. 1390 is available at the Sierra 
Madre City Manager’s office located at City of Sierra Madre City Hall, 232 W. Sierra Madre Blvd., Sierra Madre, CA. 
Ordinance 1390 becomes effective on December 28, 2017. For further information on this subject, please contact the

The purpose of MCTA 17-05 is to amend Title 8 of the Health and Safety Code establishing Chapter 8.18 – Vacant 
Residential Property Registration Requirement. The purpose of the amendment is to establish a registration program for 
vacant properties in the R-1 Zone (Single Family Residential), R-2 Zone (Two Family Residential), Hillside Management 

Zone, and Residential Canyon Zone. The purpose of the requirement is to protect neighborhoods from the effects of 

vacant properties that are not adequately maintained and to address health and safety issues that may arise at the property. 
The registration requirement will identify three responsible parties that can respond to health and safety code violations. 
The ordinance includes the following provisions: 

Responsible parties

Responsible parties includes, but is not limited to, every owner, owner of record, beneficiary, lienholder, trustee, servicing 

company, real estate agent, property management company, as well as any person acting on behalf of another responsible 
party that shall be responsible for the maintenance and security of the real property. 


Registration
The owner of a residence vacant or intended to be vacant for sixty 60 days is subject to the registration requirement. 


Property Maintenance Requirements
The property shall be maintained in a neat, clean, healthful, and sanitary condition at all times. 


Property Maintenance Plan
Real property subject to the registration requirements shall submit at time of registration a property maintenance plan. 


Security requirements
Structures, swimming pools and other potential hazards shall be secured within seventy two (72) hours of becoming vacant 
in a manner to prevent access by unauthorized persons. Responsible parties shall submit an “emergency waiver” to the City 


at the time of registration. The waiver allows the police department, fire department, code enforcement officer, or public 

safety personnel to access the property not visible from public view to respond to health and safety concerns. 

Violations, penalties and appeals

Any person who causes, permits, or suffers a violation of any provision of this chapter, or who fails to comply with any 

obligation or requirement of this chapter, is guilty of a misdemeanor and subject to administrative citations in accordance 
with Chapter 1.18 Administrative Enforcement of this code. Any responsible party may request a hearing before the Planning 
Commission in order to challenge or appeal the imposition of any additional maintenance and/or security requirements.
At the meeting on August 17, 2017, the Planning Commission conducted a public hearing and recommended to the City 
Council adoption of MCTA 17-05. 

APPEAL: If in the future anyone wishes to challenge the decision of the City Council in court, one may be limited to 
raising the issues that were raised or presented in written correspondence delivered to the City Council at, or before, the

The City of Sierra Madre gives notice, pursuant to State of California law, that the Planning Commission will conduct a 
public hearing to consider recommending adoption of Municipal Code Text Amendment 17-07 amending Chapter 17.56 – 
Nonconforming Uses Ordinance and Chapter 17.82 – Historic Preservation Ordinance. The purpose of the amendment to 
Chapter 17.82 is to update regulations for uses and structures that have become non-conforming over time due to changes 

in the City’s Zoning Code and to update Section 17.56.090 “Exemptions and Exceptions” regarding nonconforming parking 
for residential and non-residential uses by providing greater flexibility to waive the need for a certified parking study for 
non-residential structures and providing an allowance to provide one parking space for small residential additions subject 
to the approval of a minor conditional use permit. Amendments to Chapter 17.82 include a revision to the definition of 
“Bed and breakfast inn” and expands the “Adaptive reuse of historic structures” to allow “Bed and breakfast inns” with up 

to six units in single family zones and up to 12 units in multifamily zones subject to a conditional use permit.
Following a Planning Commission recommendation for approval, the proposed text amendment will be forwarded to the 
City Council for their consideration.
