ORDINANCE NO. 1352 
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SIERRA MADRE AMENDING MUNICIPAL CODE CHAPTER 17.20 – ONE FAMILY RESIDENTIAL, CHAPTER 17.24 – TWO-FAMILY RESIDENTIAL, CHAPTER 

17.30 – RESIDENTIAL CANYON, CHAPTER 17.52 – HILLSIDE MANAGEMENT ZONE, CHAPTER 17.28 – MULTIPLE FAMILY RESIDENTIAL, CHAPTER 17.36 – COMMERCIAL, CHAPTER 17.40 - MANUFACTURING, AND 
CHAPTER 17.08 – ZONING DEFINITIONS. 
THE CITY COUNCIL OF THE CITY OF SIERRA MADRE DOES HEREBY RESOLVE: 

WHEREAS, on June 11, 2013, the City Council adopted the 2008-2014 Housing Element; and 
WHEREAS, Housing Element law requires that every jurisdiction identify adequate sites to be made available through appropriate zoning and development standards to enable the development of various types of housing for all segments of thepopulation, including emergency shelters and transitional/supportive housing; and 

WHEREAS, a housing program objective of the 2008-2014 Housing Element is to amend the City’s Zoning Ordinance to make explicit provisions for a variety of special needs housing, including emergency shelters, transitional and supportive housing; 

and 
WHEREAS, the amendment will allow transitional and supportive housing to be located in the R-1 (One Family Residential), R-2 (Two Family Residential), R-3 Zone (Multiple Family Residential), R-C (Residential Canyon), HMZ (Hillside Management 
Zone) and C Zone (Commercial) pursuant to the same requirements for other uses in these zones; andWHEREAS, the amendment also includes development of objective standards to regulate emergency shelters, and will identify emergency shelters as a by right, permitted use in the M-1 Zone subject to the same development and management standards as 
other uses permitted in this zone; and

WHEREAS, the amendment will also include revised definitions of “transitional housing” and “emergency shelter”, and will add a definition of “supportive housing” to Chapter 17.08 of the Zoning Ordinance; and 
WHEREAS, an Initial Study was prepared for the 2008-2014 Housing Element in accordance with the City’s guidelines implementing the California Environmental Quality Act (CEQA). This Initial Study was undertaken for the purpose of decidingwhether the measures identified in the Housing Element to fulfill the City’s RHNA allocation may have a significant effect on the environment. On the basis of the Initial Study, the Planning Commission and City Council concluded that they will not have 
a significant effect on the environment, and a Negative Declaration was adopted by City Council on June 11, 2013; and 

WHEREAS, the Planning Commission conducted a duly noticed public hearing on December 19, 2013, and thereafter recommended that the City Council approve this Ordinance; and 

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Sierra Madre as follows: 

SECTION 1. Code Amendment. The definition of “transitional housing” in Section 17.08.020 of the Municipal Code entitled “Words, terms, phrases defined” is hereby amended to read: “Transitional housing” means rental housing provided to facilitate 
the movement of homeless individuals or families to conventional housing. Transitional housing may take the form of single-family or multi-family units, and may include supportive services operated under program requirements to allow individuals or 
families to gain necessary life skills in support of independent living. This type of housing may be occupied by a program recipient for a minimum of 6(six) months up to a maximum of 2(two) years, at which time it may be recirculated to another eligible

program recipient.

SECTION 2. Code Amendment. Section 17.08.020 of the Municipal Code entitled “Words, terms, phrases defined” is hereby revised to include: “Supportive housing” means housing with no limit on length of stay that is occupied by the target population 
as defined in the Health & Safety Code Section 53260(d), and that is linked to onsite or offsite services that assist the supportive housing resident in retaining the housing, improving his or her health status, and maximizing his or her ability to live and, 
when possible, work in the community. 
SECTION 3. Code Amendment. Section 17.08.020 of the Municipal Code entitled ‘Words, terms, phrases defined” is hereby revised to include: “Emergency shelter” means housing with minimal supportive services for homeless persons that is limited that 


is limited to occupancy of six months or less by a homeless person. No individual or household may be denied shelter because of an inability to pay. 

SECTION 4. Code Amendment. Section 17.20.020 of the Municipal Code, entitled “Permitted uses” is revised to include the following subsection: M. Transitional and Supportive Housing, when such a use is in a single-family dwelling and subject to the 


same standards as may be required for dwellings in this zone.
SECTION 5. Code Amendment. Section 17.24.020 of the Municipal Code entitled “Permitted uses”, is revised to include the following subsection: E. Transitional and Supportive Housing, when such a use is in a two-family dwelling and subject to the 
same standards as may be required for dwellings in this zone.


SECTION 6. Code Amendment. Section 17.28.030 of the Municipal Code entitled “Permitted uses”, is revised to include the following subsection: E. Transitional and Supportive Housing, subject to the same standards as may be required for dwellings in 


this zone. 

SECTION 7. Code Amendment. Section 17.30.030 of the Municipal Code entitled “Permitted uses” is revised to include the following subsection: E. Transitional and Supportive Housing, when such a use is in a single-family dwelling and subject to the 

same standards as may be required for dwellings in this zone.

SECTION 8. Code Amendment. Subsection 17.36.020(I) of the Municipal Code entitled “Residential Uses” is hereby amended to read: Residential uses, including transitional and supportive housing, other than on the ground level, which are consistent 

with the standards of Chapter 17.28 of this code and any alterations to those standards as may be approved pursuant to a permit issued under this chapter, and except as otherwise provided for parcels subject to Chapter 17.35. 

SECTION 9. Code Amendment. Section 17.52.070 of the Municipal Code entitled “Land use regulations” is revised to include the following subsection: 3. Transitional and Supportive housing. 
SECTION 10. Code Amendment. Section 17.40.010 of the Municipal Code entitled “Permitted Uses”, is revised to include “emergency shelters”. 
SECTION 11. Code Amendment. Section 17.40.025 entitled “Emergency Shelters Development Standards” is hereby added to the Municipal Code as follows: 


1. 
Property Development Standards. The emergency shelter shall conform to all property development standards of the M Zone except as modified by these development standards. 
2. 
Maximum Number of Persons/Beds. An emergency shelter for homeless persons shall contain no more than 8 (eight) beds and shall provide shelter for no more than 8 persons. Additionally, the cumulative total number of beds permitted in theM Zone shall not exceed 8 (eight). Such maximum number may be accommodated in multiple shelters not to exceed the cumulative total.
3. 
Parking. On-site parking shall be provided based on the following standards: 1(one) parking space for every 4 beds, plus ½ space designated for each bedroom designated for families with children, plus 1(one) parking space for each employee or
volunteer on duty, plus 1(one) space for every vehicle operated by the facility. 

4. 
Lighting. Adequate exterior lighting shall be provided for security purposes. The lighting shall be stationary and designed, arranged and installed so as to confine direct rays onto the premises and to direct light away from adjacent structures and
public rights-of-way. External lighting shall be of intensity compatible with the neighborhood.

5. 
Common facilities. The emergency shelter may provide one or more of the following specific common facilities for the exclusive us of the residents: 
(1) Central cooking and dining room.
(2) Recreation room. 
(3) Laundry facilities to serve the number of occupants in the shelter. 
(4) Other uses that are considered as ancillary to the primary use such as office, storage.
6. 
Onsite staff. At least one manager shall be onsite during all hours of operation of the facility. Such manager must be an individual who does not utilize the shelter’s beds or other services and who resides off-site. The manager must be
accompanied by one supportive staff member. Such staff member must be an individual who do not utilize the shelter’s beds or other services and who resides off-site. 
7. 
Security. Security personnel shall be provided during operational hours whenever clients are on the site. Security personnel are in addition to the staffing requirements in subsection (5). A security plan shall be submitted to the City prior to 
issuance of a certificate of occupancy. 
8. 
Concentration of Uses. No more than one emergency shelter shall be permitted within a radius of 300 feet from another such emergency shelter. 
9. 
Emergency Shelter Operations. The agency or organization operating the emergency shelter shall comply with the following requirements: 
(1) 
Each emergency shelter resident shall stay for no more than 90 days
(cumulative, not consecutive) in a 365-day period. Extensions up to a total stay of 180 days in a 365-day period may be provided if no alternative housing is available.
(2) On-site client waiting and intake areas shall be located inside the building.
(3) The provider shall provide an annual report of the use of the facility and determination of compliance with the City’s development standards for the use. 
SECTION 12. California Environmental Quality Act. The City Council has considered all of the evidence in the record, including the staff reports, the testimony received during the public hearing on the matter held by the Planning Commission and 

City Council, and hereby determines that the Initial Study prepared for the 2008-2014 Housing Element in accordance with the City’s guidelines implementing the California Environmental Quality Act (CEQA) was undertaken for the purpose of deciding 
whether the housing program objectives identified in the Housing Element to fulfill the City’s RHNA allocation may have a significant effect on the environment. Therefore, the City Council concludes that the proposed amendments will not have asignificant effect on the environment. 

SECTION 13. Severability; Continuation of Provisions. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unenforceable, such invalidity or unenforceability shall notaffect the validity or enforceability of the remaining sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases of this Ordinance or the rules adopted hereby. The City Council of the City of Sierra Madre hereby declares that it wouldhave adopted each section, subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or more other remaining sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases hereof be declaredinvalid or unenforceable. To the extent the provisions of the Sierra Madre Municipal Code as amended by this Ordinance are substantially the same as the provisions of that Code as they read immediately prior to the adoption of this Ordinance, then those 
provisions shall be construed as continuations of the earlier provisions and not as new enactments.

SECTION 14. Effective Date. This Ordinance shall take effect thirty days after its passage and adoption pursuant to California Government Code section 36937. SECTION 15. Certification. The City Clerk shall certify to the adoption of this ordinance

and shall cause the same to be published or posted in the manner prescribed by law.
