update, which selected housing priority sites to increase the density to 20 units per acre for parcels in the R-3-20 zone, 
30 units per acre for parcels in the R-3-30 zone, and maximum density of 42 units per acre for the parcels in the Religious 
Housing Overlay zone, which took effect on November 9, 2021. 
3) Ordinance 1450, adding 17.39 (Religious Housing Overlay) of Title 17 (Zoning) of the Sierra Madre Municipal Code. In 
November 2021, the City Council approved Sierra Madre’s Sixth Cycle Housing Element update, which selected housing 
priority sites to increase the density to 20 units per acre for parcels in the R-3-20 zone, 30 units per acre for parcels in the 
R-3-30 zone, and maximum density of 42 units per acre for the parcels in the Religious Housing Overlay zone, which took

4) Ordinance 1451, amending Chapter 17.34 (Affordable Housing), Title 17 (Zoning) of the Sierra Madre Municipal Code. 
The amendment to the City’s affordable housing ordinance is to conform to recent changes to State Density Bonus Law. 
5) Ordinance 1452, adding Chapter 17.58 (Small Lot Subdivisions), adding Chapter 16.18 (Urban Lot Splits) and adding 
Chapter 17.59 (Ministerial Design Review Permits) of the Sierra Madre Municipal Code. The purpose of this Ordinance is to 
establish objective zoning, subdivision, and design standards to promote the orderly subdivision of parcels and development 
of housing under Senate Bill 9 (SB 9) and Assembly Bill (AB 803). Both bills took effect on January 1, 2022. 
SB 9 amends the Subdivision Map Act and the California Planning and Zoning Law to ministerially approve a housing 
development containing up to two residential units on a lot in single-family residential zones, and permitting a lot split of a 
single-family zoned lot. SB 9 also applies Exceptions to Ministerial Design Review Permits and Urban Lot Splits, exempting 
properties located within an historic district or containing an historic property (on a state or local register); or located in 
an environmentally sensitive area, such as earthquake fault zones or very high fire hazard severity zone, unless the City has 
adopted mitigation measures required by existing building standards. 

AB 803 amends the Subdivision Map Act to authorize developers to apply to build a “small home lot development.” In these 
developments, a single parcel in a multi-family zone would be subdivided pursuant to a tentative and final tract map. The 
resulting “small home lot development” would consist of single-family homes on parcels owned in fee simple.

ENVIRONMENTAL DETERMINATION: With regard to Ordinance 1448, pursuant to Senate Bill (“SB”) 10 and Government 
Code Section 65913.5, an ordinance adopted in accordance with subdivision (a), and any resolution to amend the city’s 
General Plan, ordinance, or other local regulation adopted to be consistent with that zoning ordinance, shall not constitute a 
“project” for purposes of Division 13 (commencing with Section 21000) of the Public Resources Code, also known as the 
California Environmental Quality Act. This is not considered a project and therefore, pursuant to Government Code Section 
65913.5, the ordinance effecting amendments to the general plan land use designation and zoning designation is Statutorily 
Exempt from the California Environmental Quality Act (“CEQA”) as a ministerial project. 

With regard to Ordinances 1449, 1450, 1451 and 1452, the adoption of Municipal Code Text amendments is exempt from 
the California Environmental Quality Act (CEQA) under Section 15301, Title 14 of the California Code of Regulations and 
are also exempt from review because they do not meet the definition of a project under CEQA Guidelines sections 15061, 
subdivision (b)(3), and section 15378, subdivision (a) and subdivision (b)(5). The proposed changes to Chapter 17.29, 17.39, 
17.34, 17.58, 17.59 and 16.18, as authorized and complied with State Law.
