Subject: CITY COUNCIL CONSIDERATION OF URGENCY ORDINANCE 1356-U
DECLARING THE EXISTENCE OF A WATER SHORTAGE EMERGENCY
AND IMPOSING A MORATORIUM ON THE ISSUANCE NEW OR
ADDITIONAL WATER SERVICE CONNECTIONS IN ANY ZONING
DISTRICT IN THE CITY, TO TAKE EFFECT IMMEDIATELY AND
CONTINUE IN EFFECT UNTIL SHORTAGE ENDS
On July 8, 2014, the City Council will be considering the adoption of Ordinance No. 1356-U, an Urgency Ordinance of the
City Council of the City of Sierra Madre, declaring the existence of a water shortage emergency and imposing a moratorium
on the issuance of new or additional water service connections in any zoning district in the city, to take effect immediately
and continue in effect until shortage ends. Water Code 350 et seq. authorizes the City Council as governing body of a
public water supply distributor to declare that water shortage emergency conditions prevail within the area served by such
distributor whenever it cannot be satisfied without depleting the water supply of the distributor to the extent that there would
be insufficient water for human consumption, sanitation and fire protection. The Ordinance would go into effect immediately
upon adoption and remain in effect during the period of the emergency.

APPROVALS FOR CONSTRUCTION OF NEW DEVELOPMENT
REQUIRING NEW WATER SERVICE CONNECTIONS AND DECLARING
THE URGENCY THEREOF
On July 8, 2014, the City Council will be considering the adoption of Ordinance No. 1357-U, an Urgency Ordinance of the
City Council of the City of Sierra Madre, establishing an Interim Moratorium Ordinance, pursuant to Government Code
65858 on the issuance of all building permits and/or granting of discretionary approvals for construction of new development
requiring new water service connections. Government Code 65858, a provision of State Planning and Zoning law, authorizes
an interim, urgency zoning ordinance to prevent development which may be inconsistent with a plan under development, such
as the City’s intended update of its development and zoning codes to enact more stringent water conservation requirements,
pending adoption of that plan. The Ordinance would remain in effect until August 22, 2014, unless extended or terminated
by further action of the City Council.

MANDATORY WATER CONSERVATION PURSUANT TO SIERRA MADRE MUNICIPAL CODE
SECTION 13.24.210 AND DECLARING A MORATORIUM ON NEW WATER SERVICE
CONNECTIONS PURSUANT TO SIERRA MADRE MUNICIPAL CODE SECTION 13.24.220
On July 8, 2014, the City Council will be considering the adoption of Resolution 14-58, declaring the implementation of
Phase III (30%) Mandatory Water Conservation pursuant to Sierra Madre Municipal Code Section 12.24.210 and declaring a
moratorium on new water service connections pursuant to Sierra Madre Municipal Code Section 13.24.220. Pursuant to its
authority under Water Code Sections 350 and 375, and the Sierra Madre Municipal Code Section 13.24.020, the City Council
may declare that water shortage emergency conditions exists requiring the urgent necessity of establishing further mandatory
conservation measures. The resolution would be effective immediately upon adoption by the City Council and would remain
in effect until terminated by further action of the City Council.

The City of Sierra Madre gives notice, pursuant to State of California law, that the City Council will conduct a public hearing
to consider a request for a lot split for the property at 520 North Michillinda Avenue. The applicant is proposing to split the
existing 28,819- square-foot parcel into two (2) parcels measuring 14,410 square feet and 14,409 square feet. At the April 17,
2014 meeting, the Planning Commission recommended approval of TPM 13-04 to the City Council.

in an urbanized area zoned for residential uses.
