The proposed ordinances and resolution make amendments to Article 2 of Chapter 36 (Zoning Code)
of the SPMC, the Zoning Map and Part C and Figure C2.1 of the Downtown Specific Plan (DTSP)
to create new Transit-Oriented Development (TOD) Overlay Zones (TOD1, TOD2 and TOD3) in
response to and for the implementation of SB 79 (Government Code Sections 65912.155 through
65912.162, inclusive), a state bill adopted on October 10, 2025 and which goes into effect July 1, 2026
that increases the allowable density, floor area, and height for housing development projects located
on parcels zoned residential, mixed used, or commercial within proximity to certain transit-oriented
development stops. SB 79 zoning provisions apply to parcels located within ¼ mile radius from the
Metro A Line Station, as shown on the map below.
At a special meeting on May 19, 2026, the Planning Commission considered the following to effectuate
the adoption of delayed effectuation and a transit-oriented development alternative plan:
•Option A- Draft ordinances and a resolution to delay effectuation and exempt individual sites
in the Mixed-Use Core Zone in the Downtown Specific Plan Overlay and those individual
sites designated as historic on a local register in conjunction with preparation of a local
alternative Plan; or
•Option B- A draft ordinance and resolution to adopt a corresponding transit oriented
development alternative plan; and
•Option C- Draft ordinances and a resolution to delay effectuation and exempt individual
sites designated as historic on a local register in conjunction with preparation of a local
alternative Plan.
The Planning Commission adopted a resolution recommending the City Council adopt ordinances
and a resolution reflect of Option C with the following modification:
In the ¼ mile radius mile from the Metro A Line stop
•Increase the assigned density to RH-zoned properties from 50 du/ac to 70 du/ac
•Increase the assigned density to DTSP- MUC- zone properties, not in the Historic
Business District and non-Housing Opportunity Sites from 50 du/ac to 70 du/ac
•Increase the assigned density to DTSP- MUC-zoned properties in the Historic
Business District and non-Housing Opportunity Sites from 50 du/ac to 70 du/ac
•Decrease the assigned density to Housing Opportunity Sites from 152 du/ac to 140
du/ac
In the ½ mile radius mile from the Metro A Line stop
•Increase the assigned density to Housing Opportunity Sites by using a changing the
multiplier from 1.52 to 2.00
On June 3, 2026, the City Council will consider the Planning Commission’s recommendation as well
as Options A and B as described above.
This project has been assessed in accordance with the authority and criteria contained in the California
Environmental Quality Act (CEQA), and the State CEQA Guidelines. Pursuant to Government Code
Section 65912.160(c)(2), the draft ordinance and Zoning Code and Zoning Map Amendments are not
considered a project under CEQA (Division 13 of the Public Resources Code Section 21000).
