AND PEDDLERS) OF THE SIERRA MADRE MUNICIPAL CODE TO COMPLY WITH STATE REQUIREMENTS FOR 
THE REGULATION OF SIDEWALK VENDORS AND DECLARING THE URGENCY THEREOF IN ACCORDANCE 
WITH GOVERNMENT CODE SECTIONS 36934 AND 36937(B)

On September 17, 2018, Governor Brown signed Senate Bill No. 946 (SB 946), which establishes a new framework for 
regulating “sidewalk vendors” on public property. Effective January 1, 2019, the Senate Bill decriminalizes sidewalk vending 
and limits local regulations to those expressly provided for in the Bill or are otherwise ‘directly related to health, safety, or 
welfare concerns.” 

On December 11, 2018, the City Council will consider the adoption of Ordinance No. 1406-U, an Urgency Ordinance of 
the City Council of the City of Sierra Madre, amending Section 10.24.100 – “Unlawful parking by peddlers and vendors” 
by removing the prohibition of sidewalk vending from the code section; amending the title of Section 12.12.050 (“Outdoor 
dining”) to read “Outdoor dining attached to a fixed place of business;” and adding a new Section 12.12.055 “Sidewalk 
vendors and peddlers” to regulate such use by requiring a City business license and an encroachment permit if located in the 
public-right-of-way or on City property. The Ordinance also includes requirements regulating the time, place, and manner 
of sidewalk vending; imposes regulations on health, safety, and welfare and establishes an administrative citation set by a 
graduated schedule of fines set at the maximum level allowed by state law.

The proposed ordinance complies with the requirements of Senate Bill 946. The Ordinance is proposed to be approved as 
an urgency ordinance upon specified health and safety findings and a 4/5 vote pursuant to Government Code section 36937.
